Clear rules for using XYSHIMA.
These Terms govern access to and use of XYSHIMA, an AI study platform offered under the Xynara Analytics brand. They are intended to operate together with the Privacy Notice, AI Transparency Notice, Child & Teen Safety Policy and Cancellation & Refund Policy.
1. Provider, scope and contact
XYSHIMA is offered by Masoud Elahian, trading as Xynara Analytics, currently operating as a sole-trader / individual online business and not as a limited company. The consumer service covered by these Terms includes the XYSHIMA website, account system, AI study features and paid subscriptions.

If registration, VAT or other statutory trader identifiers later become legally applicable, they will be added to the Trader Information page and displayed where required. Required pre-contract information forms part of the information supplied before a paid consumer contract is concluded.
2. Eligibility, age and guardian authorisation
You must provide accurate age, country and account information. XYSHIMA does not currently permit an independent account for a user under 14. Users aged 14–17 must have parent or legal guardian authorisation to create and use the account. A paid subscription for a user under 18 must also be separately authorised by a parent or legal guardian.
Country-specific rules can require stronger protections than these product rules. Where mandatory local law requires a higher age threshold, verified parental consent or another safeguard, that requirement prevails.
3. Account security and truthful information
You are responsible for protecting your login credentials and for activity carried out through your account. Do not sell, transfer or commercially share account access, impersonate another person, provide false eligibility information, or deliberately circumvent age, subscription, security or usage controls. Tell us promptly if you believe your account has been compromised.
4. What XYSHIMA provides
XYSHIMA provides study assistance, AI tutoring, practice generation, diagnostics, flashcards, planning, notes, uploaded-material support, progress tracking and probabilistic learning estimates. Features may change as the product develops, but changes will not remove mandatory consumer rights or retroactively alter an already completed payment without a lawful basis.
XYSHIMA is not a school, university, examination board, admissions authority, licensed teacher, official marking body or guarantee of educational results.
5. AI transparency, limitations and verification
Some XYSHIMA features use artificial intelligence. When a student interacts with an AI feature, the service identifies it as AI. AI-generated responses, questions and explanations may contain errors, omissions or inappropriate conclusions. Important academic information should be compared with authoritative course materials, teachers or official specifications where appropriate.
Mastery, readiness, retention, misconception and similar scores are probabilistic study guidance. They are not official grades, admissions decisions, disciplinary decisions or guaranteed predictions. XYSHIMA is not designed for schools or institutions to use these estimates as the sole basis for high-impact decisions about a learner.
Where XYSHIMA uses automated verification for generated assessment answers, that process reduces risk but does not guarantee zero errors. Users should use the in-app reporting controls when content appears incorrect, ambiguous or inappropriate.
6. Your content and uploaded materials
You retain ownership of material you create or upload. You grant XYSHIMA a limited, non-exclusive, revocable permission to host, process, index, transform and transmit that material only as reasonably necessary to provide, secure, troubleshoot and improve the service for you, subject to the Privacy Notice and applicable law.
You are responsible for having the right to upload the material you submit. Do not upload unlawful material, malware, confidential information you are not entitled to disclose, or content that infringes another person's rights. We may remove or restrict material where reasonably necessary to comply with law, protect users or secure the service.
7. Academic integrity and acceptable use
XYSHIMA is designed to support learning, not to facilitate misconduct. You must follow the academic-integrity rules of your school, examination board or institution. You must not use the service to attack systems, bypass usage limits or payment controls, distribute malware, scrape the platform at scale, reverse engineer protected service components except where law expressly permits it, resell the service without written permission, interfere with other users, or use XYSHIMA for unlawful activity.
8. Trial, Pro subscriptions and contract formation
Where a trial is offered, the trial duration and limits shown at signup apply. XYSHIMA Pro may be offered monthly or annually. Before payment, the checkout displays the selected plan, total recurring price for the billing period, billing interval, automatic-renewal nature of the subscription and applicable cancellation/refund information.
A paid subscription contract is formed when the payment provider confirms the subscription and XYSHIMA accepts and activates the corresponding paid entitlement. Paid access is not granted merely because a checkout page was opened.
Required subscription acknowledgements are not pre-selected. The user must actively confirm the recurring charge, refund policy and immediate start of paid access before proceeding to PayPal.
9. Automatic renewal, cancellation and price changes
A Pro subscription renews automatically at the selected monthly or annual interval until renewal is cancelled. You may cancel future renewal through the Plan & AI area. Cancellation stops future renewal charges; unless a refund or withdrawal applies, access normally continues until the end of the already-paid period.
If XYSHIMA changes the recurring price of an existing subscription, the new price will not be applied secretly or retroactively. Where required, advance notice will be given before the changed price takes effect, together with a reasonable opportunity to cancel before the next affected renewal. Mandatory local notice or consent requirements prevail.
10. Refunds, accidental renewals and statutory withdrawal
The Cancellation & Refund Policy forms part of these Terms. XYSHIMA currently provides voluntary accidental-renewal courtesy windows of 24 hours for monthly renewals and 48 hours for annual renewals, provided the renewal was genuinely accidental and there has been no substantial post-renewal use.
Where applicable consumer law gives a statutory withdrawal or cooling-off right, that right is separate from ordinary cancellation and voluntary refund rules. The current Plan & AI interface provides an initial 14-day withdrawal route for eligible first paid subscriptions. Mandatory consumer rights always override any narrower voluntary XYSHIMA policy.
Billing errors, charges made after an effective cancellation, materially defective service and other legally protected situations are assessed separately and are not excluded merely because a voluntary courtesy-refund window has expired.
11. Immediate performance during a withdrawal period
Where applicable law provides a withdrawal period for a service contract, checkout may ask the consumer to expressly request that paid performance begin immediately rather than waiting until the withdrawal period expires. That request is recorded separately. Any legal consequences of immediate performance, including any lawful proportionate charge or continuing withdrawal right, are governed by mandatory consumer law and are not replaced by these Terms.
12. AI capacity and Extra AI
Plans may include measured AI capacity. Different AI operations can consume different amounts of internal capacity because they have different technical costs. Optional Extra AI may be sold separately. The price and any specific refund treatment shown at purchase apply together with the Refund Policy and mandatory consumer rights.
13. Payments and third-party services
Payments are processed through PayPal. PayPal may offer eligible buyers additional payment methods such as cards. Payment credentials are handled by the payment provider rather than stored as raw payment credentials by XYSHIMA.
XYSHIMA also depends on third-party infrastructure and AI providers. Their temporary outages can affect service availability. We remain responsible for our own obligations under applicable law and do not use third-party involvement to remove non-waivable consumer rights.
14. Intellectual property
XYSHIMA software, branding, original interface design, platform logic and original service content are protected by applicable intellectual-property laws and remain the property of their respective owners. These Terms grant a limited, personal, non-exclusive, non-transferable right to use the service for permitted educational purposes while the account is valid.
Nothing in these Terms transfers ownership of XYSHIMA's software, trademarks or underlying systems. Rights in third-party educational materials remain with their respective owners.
15. Feedback
If you voluntarily send suggestions or product feedback, you permit XYSHIMA to evaluate and use that feedback to improve the service without an obligation to pay for the suggestion. This does not transfer ownership of private study content, uploaded documents or personal data.
16. Suspension and termination
We may restrict or suspend access where reasonably necessary for security, fraud prevention, non-payment, legal compliance, material abuse of the service or serious breach of these Terms. Where proportionate and legally appropriate, we will provide notice and an opportunity to address the issue.
Termination or suspension does not extinguish rights that accrued before termination, including mandatory refund, withdrawal, privacy or complaint rights. We will not use account termination as a device to avoid lawful consumer obligations.
17. Availability and maintenance
We aim to keep XYSHIMA reasonably available but do not promise uninterrupted or error-free operation. Maintenance, security incidents, provider outages, internet failures and events outside reasonable control may cause temporary disruption. Where a disruption creates a statutory consumer remedy, these Terms do not remove that remedy.
18. Liability and reliance
To the maximum extent permitted by law, users should not make high-impact academic, financial, health, legal or safety decisions solely from AI output. XYSHIMA's educational estimates are support tools rather than professional or official determinations.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability that cannot lawfully be excluded for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer protections.
19. Privacy, profiling and children's data
Personal-data processing is described in the Privacy Notice. AI-specific information appears in the AI Transparency Notice. Child and teen safeguards appear in the Child & Teen Safety Policy, and browser storage is described in the Cookie Notice.
Marketing consent is optional and separate from acceptance of these Terms. Withdrawing marketing consent does not terminate the service.
20. Changes to these Terms
We may update these Terms to reflect legal requirements, security changes, new features or material product changes. Minor editorial changes may take effect when published. If a change materially affects the contractual relationship and renewed acceptance is appropriate or legally required, XYSHIMA will present the new version in the product and require active acceptance before continued use of the affected service.
Changes do not retrospectively remove rights or remedies that arose under an earlier version.
21. Complaints and disputes
Please contact support@xyshima.com first so we can investigate billing, content, privacy or service complaints. This informal route does not prevent a consumer from contacting a competent consumer-protection or data-protection authority or from using a court or other dispute mechanism available under applicable law.
22. Governing law and consumer jurisdiction
To the extent a choice of law is permitted, these Terms are governed by the laws of the Republic of Cyprus. This choice does not deprive a consumer of mandatory protections that apply under the law of the consumer's habitual residence or of any jurisdiction rights that cannot lawfully be waived.
23. Severability and entire agreement
If a provision of these Terms is found unenforceable, it will be interpreted or limited only to the extent necessary, while the remaining provisions continue to apply where legally possible. These Terms, together with the policies expressly incorporated into them and the plan-specific information shown before purchase, form the contractual terms for the XYSHIMA consumer service.
